Because of this, it is important that you understand how good credit opens doors that you can not access without it.

Did you know that the credit bureaus are NOT government agencies? Actually, they are publicly traded companies out to make obscene profits by manipulating your credit scores! Fortunately, Congress has passed legislation which regulates the credit bureaus, and for once that legislation was passed with your interests in mind.

The Fair Credit Reporting Act ("FCRA") was enacted in 1970 and has been regularly updated thereafter. From the beginning, it was designed to protect real people like you and I from abuse by the credit bureaus. Put simply, the FCRA provides the ability for a consumer to dispute the "completeness or accuracy" of any item with the bureaus. Once a bureau receives any dispute, it is required by law to reinvestigate the issue, and if the details can not be verified within 30 days, the item must be deleted.

What if the information is accurate?

The FCRA does NOT say that the item itself must be inaccurate in order for it to be deleted; it merely states that if you dispute the completeness or accuracy of the item and it can not be verified within 30 days that it must be deleted.

What can I do if they don't remove it?

If the bureaus do not comply with the law in a timely fashion and remove the item(s) that they are unable to verify, you can sue them to remove the item(s). Unfortunately, it's not that easy. Because the bureaus are large organizations, they will often say that they have verified your items in ways which on the surface seem pretty convincing. It's a great sleight of hand - but as lawyers, we know that what they are doing is often fraudulent. In the mean time, imagine threatening to sue the credit bureau by yourself and the effect (or lack thereof) that it would likely have on such a large organization.
